What is the Illinois Accountability Act?
The Illinois Accountability Act restores the ability to hold government officials accountable when they violate our constitutional rights. For too long, the doctrine of qualified immunity has shielded officials from facing consequences—even in clear cases of misconduct. This bill ensures that when someone’s rights are violated, they can seek justice in state court, just like anyone else.
By passing the Illinois Accountability Act, our lawmakers can take a stand for fairness, transparency, and justice—so that no one is above the Constitution.
Why now?
Across the country, we’ve seen what happens when government officials act without accountability—families are left without justice, communities lose trust, and our constitutional rights lose meaning. The need for reform is urgent.
Illinois can lead the nation. When our rights are violated, we deserve a path to justice. The Illinois Accountability Act opens the courthouse doors so victims of government abuse can finally be heard and government officials can be held to the same standards as everyone else. Illinois has the chance to set a national standard for fairness, responsibility, and integrity.

Endorsed by the Massey Commission
The Massey Commission for Sangamon County recently included ending qualified immunity among its official Calls to Action for community reform. This landmark endorsement highlights growing recognition that real accountability is essential to rebuilding public trust in Illinois.
By supporting the Illinois Accountability Act, lawmakers can act on one of the Commission’s key recommendations—ensuring that when rights are violated, victims have a clear path to justice.

Explainer: What is Qualified Immunity?
Qualified immunity is a doctrine invented by courts that often prevents people from holding government officials accountable for violating constitutional rights unless they can point to a prior case with nearly identical facts. That “gotcha” requirement shuts the courthouse doors to many victims—even when the right is clear.
How does ending it help Illinois?
Ending qualified immunity ensures Illinoisans can present their civil rights claims in court. It promotes consistent standards, deters misconduct, and strengthens trust between communities and public institutions.
